A federal court judge has thrown out a key part of a deal that allows a pharmaceutical company to sell a drug that could help doctors diagnose the condition of their patients.
The federal judge in the city of Cancun, Mexico, said she would give the company permission to sell its product, known as VIAGRA, the generic version of Viagra, which the FDA has approved for sale in the country.
The judge said a doctor, who was not a part of the deal, could refuse to prescribe the drug because of safety concerns.
That meant the drug would only be sold by a licensed U. S. pharmacy, which would be able to determine if the patient had a medical condition and could sell the drug to a pharmacy employee for a lower price.
The drugmaker had not disclosed when it would begin selling the drug, but doctors at the Mexican hospital said they were aware of what they were seeing.
Patients at the hospital were told they could go ahead with the prescription, and the pharmacy would provide the necessary paperwork for getting it.
While the FDA has not said what the company could do about the issue, the drugmaker told the court it could.
"The FDA has not approved any prescription drug that would be approved by the physician," said Carmen Catizone, executive director of the National Pharmaceutical Action Network, a nonprofit group that works to stop the spread of HIV/AIDS.
Catizone said the drugmaker was aware of the drug's safety issues but wanted to keep them secret.
She also said the FDA had asked the drugmaker to disclose the risk of side effects, and she said she was concerned about the way the FDA had handled the issue.
"I am concerned about the way the FDA has handled the issue," Catizone said. "The company has had the opportunity to put the drug on the market before it was approved."
The drugmaker has said it has agreed to sell VIAGRA to the company, which is expected to begin selling the drug in the country at about the same time.
